Matters Needing Attention In Designing Trademarks

According to our law, some designs and labels are not allowed to be used for trademarks.

(1) the characters, graphics and combinations of trademark design should have notable characteristics and are easy to identify; (2) the Chinese and foreign languages and the Pinyin of Chinese characters used in trademark shall be standardized; (3) according to the eighth provision of the trademark law, trademarks shall not be used with the following names and figures.

It is the same or similar to the flag, emblem, or name of the international organization; it is the same as or similar to the "Red Cross" or "Red Crescent" logo; the general name and figure of the commodity; the quality of the commodity, the main raw materials, functions, uses, weight, quantity and other basic characteristics; and it has national discrimination; it is exaggerated and fraudulent; it is harmful to the socialist moral trend or other adverse effects; the name of the administrative division at or above the county level or the foreign place name known to the public. It is the same or similar to the national name, national flag, national emblem, military flag or medal of People's Republic of China;
